Treatment Taken at private Nursing home / Clinic

No. 23036629 -------------------------------------------------------------------------------------------------------------------------------------------------------------------------- No. S-14025/46/92-MS Government of India Ministry of Health and Family Welfare Nirman Bhawan, New Delhi – 110011 Dated the 4th February, 1993 Office Memorandum Subject – CS (MA) Rules, 1944 – Reimbursement of expenditure involved on emergent cases for the treatment taken at private nursing home/clinic – Delegation of powers – Regarding. The undersigned is directed to say that under the CS (MA) Rules, 1944, vide Miscellaneous Important Decisions No. 5 under Section VII of the compilation of the CS (MA) Rules and further modified vide O.Ms. No. S-14012/9/75-MC (MS) dated 23.2.77, 7.5.79 and 18.6.82, powers have been delegated to the Heads of Departments to allow reimbursement of the medical claims in respect of the treatment obtained under emergency at private hospitals, as distinct from private nursing home/private clinic, subject to item-wise ceilings as per the rates prescribed in the Annexure to the O.Ms. referred to above without any financial limit on the total amount to be reimbursed. 2. However, although the broad guidelines provided in para 1 (iv) of the O.M. dated 18.6.82 referred to above are only indicative and not exhaustive, a large number of cases are being referred to this Ministry/Dte. G.H.S. for seeking relaxation of the rules stating that the hospital is not run on ‘No profit and No Loss Basis’, which otherwise could have been settled by the concerned Department under the delegated powers. 3. It has now been decided by the Government that in order to eliminate the confusion regarding distinction between the private hospital and a private nursing home Clinic, the delegated powers referred to above are applicable to all private medical institutions without making any distinction between a private hospital and a private nursing home/clinic. 4. the medical claims for specialized treatment for heart diseases, kidney transplantation, etc. may be settled as per the schedule of rates approved for the treatment of C.G.H.S beneficiaries from time to time at private recognized hospitals under that Scheme or the actual charges, whichever is less, and all other cases may be settled as per the item wise ceilings prescribed in the Annexure to the O.Ms. referred to above. No. references should be made to this Ministry/Dte. G.H.S. in the matter for further relaxation of the Rules and may be settled by the concerned Ministry/Department. 5. In this connection it may be reiterated that as already stated in para (iii) of the O.M. dated 18.6.82 referred to above, reimbursement of expenses incurred on treatment obtained in the private clinics/nursing homes of the Authorised Medical Attendants would not be admissible under the above provisions and also in relaxation of the CS(MA) Rules even in emergent cases. 6. All pending cases may be decided accordingly, However, the cases which are already settled or decided, may not be re-opened. 7. This issues with the concurrence of the Department of Pension and Pensioners’ Welfare vide their U.O. No. 272/92 P& PW (K) dated 19.10.1992 and the Ministry of Finance Deptt. Of Expenditure) vide their U.O. No. 1441/E.V/92 dated 17.11.1992. 8. In so far as persons serving in the Indian Audit and Accounts Deptts. are concerned, this issues with the concurrence of the office of the comptroller and Auditor General of India vide their U.O. DELAY AND IRREGULARITIES IN IMPLEMENTATION OF MACP SCHEME – CLARIFICATION REGARDING The matter has taken up the matter with Secretary (Posts) regarding undue delay and irregularities observed in implement action of Modified Assured Career Progression Scheme (MACP). It is being denied to eligible officials in some circles and sought the intervention of the Directorate DOP caused necessary classifications to sort out the problems prevailing in the Circles. Government of India Ministry of Communication & IT Department of Posts (Pay Commission Cell) Dak Bhawan, Sansad Marg, New Delhi - 110116 No. 4-7/(MACPS)/2009-PCC Dated: 18th Oct, 2010 All Chief Postmasters General, All Postmasters General General Managers (Finance) All Directors of Accounts Postal Sub: DELAY AND IRREGULARITIES IN IMPLEMENTATION OF MODIFIED ASSURED CAREER PROGRESSION SCHEME – CLARIFICATIONS regarding. Sir/Madam, I am directed to refer to this Directorate's OM dated 18 Sep, 2009 communicating the detailed guidelines for implementation of Modified Assured Career Progression Scheme (MACPS) and several other clarification issued on this subject. 2. The General Secretary, All India Postal Employees Union Group 'C' has represented to the Secretary (Posts) alleging that the Modified Assured Career Progression Scheme (MACPS) is being denied to eligible official in some Circles and sought the intervention of the Directorate in clarifying the position. The contentions of the General Secretary have been examined and the following clarifications are provided for guidance and strict observance. Sl. No. Point on which clarification sought Status Position 1 Eligibility of MACPS to a direct recruited Postal Assistant conferred with TBOP – It has been represented that in some Circles the directly recruited Postal Assistants who were accorded financial upgradation under one time bound promotion scheme on completion of 16 years of satisfactory service are not being given the 2nd MACPS on the ground that the officials have not completed 10 years of service TBOP Scale/Grade with grade pay of Rs.2800. Attention is drawn to Para No. 28 of Annexure-I to this office OM dated 18-09-2009. It is stated that a directly recruited Postal Assistant who got one financial upgradation under TBOP Scheme after rendering 16 years of service before 01.09.2008, will become eligible to 2nd MACP on completion of 20 years of continuous service from date of entry in Government service or 10 years service in TBOP grade pay or scale or combination of both, whichever is earlier, However, financial upgradation under MACPS cannot be conferred from a date prior to 01.09.2008 and such 2nd financial upgradation for the above referred category of officials has to be given from 01.09.2008. They will also become eligible for 3rd MACP on completion of 30 years of service or after rendering 10 years in 2nd MACP, whichever is earlier. 2 Eligibility of MACP to a directly recruited Postal Assistant having qualified in PO & RMS Accounts Examination and opted initially for defunct scale & later opted out of it & who have got financial upgradations under TBOP and BCR subsequently – The staff side has alleged that Postal Assistants who have qualified in PO & RMS examination who initially opted for defunct scale and later switched over to normal line and accorded financial upgradations under TBOP/BCR schemes are denied 3rd MACP construing that PO & RMS Accountants is 1st MACP and TBOP/BCR are off set against 2nd and 3rd MACP. PO & RMS Accountants examination is a qualifying one and the Postal Assistants who have passed the examination are posted as Accountants with some special allowance. They will be continued in the cadre of Postal Assistants in the common gradation list. The PO & RMS Accountants who initially opted for defunct pay scale of Rs.380-620 and later switched over to normal line of promotion in PA cadre and given financial upgradations under TBOP/BCR Schemes will become eligible for 3rd MACP under MACPS provided that they have not earned any other regular promotion and subject to rendering of 30 years of continuous service from the date of entry in the PA grade or 10 years continuous service in the BCR grade, whichever is earlier. Denial of 3rd MACP on the said ground is not in order. 3 Eligibility of MACP to a promoted official to PA Cadre and having completed 10 years of service in PA cadre – It was stated by staff representatives that in some Circles, the officials who were promoted from the lower cadres to Postal Assistants and on completion of 10 years in the said Postal Assistant cadre are not considered for 2nd MACP on the plea that they have not completed 20 years of service from the date of entry in clerical cadre. The attention of the Circle is drawn to Para No. 28 (A) (1) in the Annexure-I. In case of a lower grade official promoted to PA cadre, having got one promotion to PA cadre before completion of 10 years of continuous service, it will be off set against 1st MACP and on rendering 10 years continuing service in the clerical grade/scale or on completion of 20 years service from the date of entry would become eligible for 2nd MACP, whichever date is earlier. However, financial upgradation under MACPS cannot be conferred from a date prior to 01.09.2008 as the scheme became operational from this date only. 4 No. 4-Eligibility of MACP on completion of 30 years of service from date of entry as on 01.09.2008, declining regular promotion to LSG during 2009 and 2010 – The General Secretary intimated that certain officials who become eligible for 3rd MACP on 01.09.2008 are denied the same on the ground that they have declined the regular promotion to norm based LSG in 2009 and 2010. The attention is drawn to para 25 of Annexure I to order on MACPS issued on 18.09.2009 providing that "if a regular promotion has been offered but was refused by the employee before becoming entitled to a financial upgradation, no financial upgradation shall be allowed as such an employee has not stagnated due to lack of opportunities. If, however, financial upgradation has been allowed due to stagnation and the employees subsequently refuse the promotion, it shall not be a ground for withdrawal of the financial upgadation. He shall, however, not be eligible to be considered for further financial upgradation till he agrees to be considered for promotion and the second and the next financial upgradation shall also be deferred to the extent of period of debarment due to the refusal." Therefore, the issue raised is already covered under Para 25 and in such cases where due date of financial upgradation precedes the refusal for regular promotion, financial upgradation under MACPS shall be allowed. 5 Eligibility of MACP due on 01.09.2008 for officials due to currency of the penalty of recovery in consequence of disciplinary proceedings or disciplinary proceeding contemplated. The staff side represented that some Circle have not considered the cases of officials for MACP on the date of introduction on the pretext that the punishment of recovery from their pay is current or disciplinary proceedings contemplated at the time of screening of the officials by the Committees which were constituted for considering financial upgradation under MACPS Para 18 of Annexure-I to OM dated 18.09.2009 provides that – "In the matter of disciplinary/penalty proceedings, grant of benefit under the MACPS shall be subject to rules governing normal promotion. Such cases shall, therefore, be regulated under the provisions of the CCS (CCA) Rules, 1965 and instructions issued there under." Attention of the Circle is drawn to Department of Personnel and Training Om No. 22011/2/78-Estt. (A) dated 16.02.1979 communicated in DGP&T letter no.35-1/79-SPB-II dated 07.05.79. According to these orders, the penalty of censure or recovery of pecuniary loss are not a bar for penalty for promotion if the findings of the DPC are in favour of the employee. Similarly, the officials who were facing disciplinary action as one the date of actual due date of their upgradation can only be not considered. 3. The Circles are requested for bringing the above position to the notice of all Divisional Heads and concerned authorities for scrupulous observance and to avoid any grievance to the officials. 4. The limits for holding of Screening Committee as provided in Para 11 of this Directorate OM of even number dated 18.09.2009 may be strictly adhered to on concluding action of Scrutiny Committee ordered under letter of even number dated 01.09.2010. 5. Guidelines on Air Travel on Tours/LTC.

Subject: Guidelines on Air Travel on Tours/LTC.

This Department is receiving repeated references seeking clarifications with regard to purchase of Air tickets through authorized agents and relaxation for travel by Airlines other than Indian Airlines. The following guidelines may be noted for compliance:
1. On Official Tours:

(i) For travel by Airlines other than Air India because of operational or other reasons or on account of non-availability of Air India flights, individual cases for relaxation to be referred to M/o Civil Aviation, as stated in this Ministry's OM No. 19024/1/2009-E.IV dated 13.07.09.
(ii) Air Tickets may be purchased directly from Airlines (at Booking counters/Website of Airlines) or by utilizing the services of Authorized Travel Agents viz. M/s Balmer Lawrie & Company, M/s Ashok Travels & Tours.
2. LTC:

(i) Travel by Air India only.
(ii) In Economy class only, irrespective of entitlement.
(iii) LTC-80 ticket of Air India only to be purchased.
(iv) Air Tickets may be purchased directly from Airlines (at Booking counters/Website of Airlines) or by utilizing the services of Authorized Travel Agents viz. M/s Balmer Lawrie & Company, M/s Ashok Travels & Tours and IRCTC (to the extent IRCTC is authorized as per DoP&T OM No. 31011/6/2002-Estt.(A) dt. 02.12.09).

3. LTC for J&K:

(i) Relaxation to travel by Private Airlines to visit J &K while availing LTC is available to all the categories of Govt. employees, including those entitled to travel by Air [DoP&T OMs No. 31011/2/2003-Estt.(A-IV) dated 18.06.10 and 05.08.10 refer].

(ii) For purchase of Air tickets, however, the procedure as given under para 2 (iv) above should be followed.

4. All Ministries/Departments of Govt. of India are requested to strictly adhere to these instructions.

General Secretary's Circular

Hope you will find it in a right way ! Since the period of my previous circular dated 20 May 2010, we are still striving under difficult circumstances. And now we have got a little beam of light providing oxigen do this association.
Efforts made to Sort-out the Problem
As I have already described in my previous circular about the conspiracy made by the rival unions alongwith some officers of deptt. and it literaly hurt the peace loving senior people of this association.I met Mr Subhash Chander, Director (Staff Relation & Legal Matters) severally & requested him to sort out the problem created un-necessary in the smooth way of this association. Last time I met him with Mr. M.I.Khan, our ex-President in the last week ofJuly 2010 & discussed on the matter.At the moment he responed positively, than again, I wrote a letter to Mr Subhash Chander, Director SR & Legal on 31 July 2010 ( copy of that letter is attached h/w).

Sir/Madam,

I am directed tom say that D/O Posts has been following the policy of Rotational Transfers for the last many years and every year guidelines used to be issued for the field units as to the manner in which these were to be effected .In super session of all the previous orders on the subject ,a new set of guidelines were issued to regulate the rotational transfer of staff vide Dte letter No 69/4/79-SPB.I dated 12-11-1981 and 16-12-1981.The last policy guidelines were issued vide Dte letter No141-35/2001-SPB.II dated 11-04-2001 wherein it was stated that there was no deviation in the policy guidelines for rotational transfers issued for the year 200-2001 for adopting the same for the year 2001-2002.It was further stated therein that in view of the well defined principles of rotational transfers in Department and provision of tenures and other administrative instructions ,annual issue of rotational transfer guidelines were being discontinued and changes in the existing policies would be communicated whenever necessary. Subsequently Directorate vide letter No 141-132/2009-SPBII dated 2-6-2009 issued instructions regarding retention of staff for implementation of Core Banking /solution in the Post Offices including SBCO staff and AOICO(SB).

2. Modified Assured Career Progression Scheme (MACPS) has been introduced vide Dte letter No 4-7/(MACPS)/2009-PCC dated 18-09-2009 whereby three financial upgradation of pay scales are permitted to the officials who were stagnated in their career for further regular promotion,after completion of 10,20 and 30 years respectively.It has been stated that the TBOP and BCR Schemes shall stand withdrawn w.e.f 1.9.2008.

3. Demands have been raised m for issuing new guidelines about utilization of MACP-I,MACP-2 and MACP-3 officials in the Postal Operative offices and in the Postal Divisional offices. The matter has been carefully considered in the light of Recruitment Rules and the objective of MACPscheme. MACP Scheme clearly states that on grant of financial upgradation under the scheme,there shall be no basis. Thus, those who they would continue to function granted ACP, change in the designation, classification or higher status. The financial up gradation would be on non-functional against their existing posts.

4. However rotational transfers may continue to be made as per guidelines issued by the directorate from tome to time.

FROM THE DESK OF GENERAL SECRETARY

Circular No.05 Dt. 20 May 2010 To:
All CHQ Office Bearers, All Circle / Regional / Divisional Secretaries,
Dear Brothers / Sisters, Namaskaar !

Hope you will find it in a healthy way ! Since the period of my previous circular dated 05 March 2010, we are srtriving under difficult circumstances to do something. We have to struggle against the attacks made on our association.
Conspiracy Made by Rival Unoins

During the re-verification process of memebership, a conspiracy was organized by National P-III union against our Supervisors Association, being afraid of our unity & strength. Director-SR & Legal wrote a letter to C.P.M.G.U.P.Circle on 03-03-2010 stating that the position of our Association in terms of recognition & also in terms of membership remain as it was at the time of passing of interim order by the court on 06-05-1997.

Objection of National association of postal employees group-c was only in regards for not to accept fresh letters of authorization in favour of our association's Saharanpur (U.P.) branch.The fact is that Supervisors Association Saharanpur U.P. branch was running smoothly. But as a result of above communication of Director SR dated 03-03-2010, SSPOs Saharanpur/ CPMG UP did'nt extend the trade union facilities to the bi-annial election of this branch held on 27th Feb 2010. This was quite illegal & undersigned opposed the misinterpretation made by department, representing to Secretary Posts & Director SR in written on 20 March 2010, 15 April 2010, 01 May 2010 and also met him personally . The sound of Director SR's communication is not limited to the U.P.circle only, but it is spreading over the other circles also. In the light of this circulation injustice is being caused to the various branches of our association and trade unioun facilities are stopped in many circles/divisions without assigning any written reason.
After my urged that depatment is forcing to this association to knock the door of court of law, Mr.Subhash Chander, Director SR & Legal, called me on phone and admitted that this action has been taken wrongly without taking the factual position of stay ordered by Ho'ble High Court in consideration. But still we are waiting for a positive reply from Department.
We Have to Make Forceful Attempt

We are a peace loving association of senior people of this department and in recognized status from more than 40 years.We always proud of our ex-leaders like Mr.N.K Sharma. Mr.K.Sarvotthaman and our patron Mr. K.Kanniappan. As you all know that the Hon'ble High Court of Delhi vide order dated 6-5-1997 passed in C.W. No. 1827/97 was pleased to order notice for 11-07-1997 and till the next date of hearing, Status Quo as of thatday, should be maintained.
What was the actual status of this association on 06-05-1997 ?

(A) We had well recognized status all over the country.
(B) We were enrolling the employees of TBOP,BCR,LSG & HSG cadre as our members.
(C) We were strictly following the RSA Rules 1956 by forming fresh branches & enrolling fresh members as well as organizing fresh biannial elections of office bearers at diffrent levels of circle/divisions.

(D) We had an approved constitution by which this association was running smoothly.

Since last 15 years department was obeying the orders of Hon'able High Court by accepting & maintaining all above A,B,C,D points positively. Now suddenly what new happened in Feb-March 2010 so that Director SR had to issue such an orders regarding a divisional branch (Saharanpur U.P.) of this association which effected adversely peaceful working of the Supervisors Association all over the country . I have detailed communicated the facts and situation of our association in my three letters addressed to Secretary Posts as well as Director SR, but NO reply is given by them.
In such a position we have to stand together to show our unity & strength to save our status and honour. As adviced by Mr K.kanniappan & other members of CWC, our senior advocate has moved an application before the Hon'ble High Court of Delhi this month, stating all the matter & the partial behaviour of department. Application is listed for hearing after vacation and we hope for an early relief in this regard.
Remittance of Quota Money / Donations

As all of you know very well that financial position of this association is not so sound.Most of the Circle and Divisional units are NOT remitting their quota money to CHQ. It's a time of our struggle to re-gain our status and we have to expend a lot of money to pay our advocate as well as in other related matters. So all of you are requested to strengthen the CHQ by remitting Quota money and also special Donations with open hand.

PLI Workshop
A workshop was organized by Postal Life Insurance Directorate, New delhi on 14th May 2010 at Postal Staff College Ghaziabad . I was invited as General Secretary of Supervisors Association . I have participated the workshop and expressed the views of our association which are appriciated very much by Dr.Uday Balakrishnan,Member Postal Service Board and Mr.S.K.Sinha,Chief General Manager PLI .

SUBJECT:-Consideration of ACRs and application of Bench Mark for notional Promotions in LSG/HSGII/HSGI/financial up gradation under TBOPBCR scheme-Reg.

Sir/Madam
I am directed to say that one of the agenda items submitted by the staff side for discussion in the JCM relates to “Irregular application of Benchmark of current period for notional promotions.”

The staff side has stated that `the instructions of DOPT dt 16-06-2000,that only CRs for the year immediately preceding the years of vacancy/panel should be considered if DPC meetings are held later than the schedule prescribed in model calendar’, has not been taken note of by many circles and current bench marks were applied wrongly for the notional promotions. It has also been stated that in some circles, the bench mark was applied for TBOP/BCR promotion, despite the existence of clear cut orders from the Directorate that Bench mark should not be applied for BCR promotions.
2. It may be recalled that the Department of Personnel & Training (DOPT) vide its Office Memorandum No 22011/7/98-Estt (D) dated 6-10-2000,while referring to Para 6.2.1(b) of instructions circulated vide their OM No 22011/5/86-Estt(D),dated 10-4-1989,has substituted Para 6.2.1(b) as under :“:The DPC should assess the suitability of the employees for promotion on the basis of their service records and with particular reference to the CR s for five preceding years irrespective of the qualifying service prescribed in the Service/ Recruitment rules. The preceding Five years’ for the aforesaid purpose shall be decided as per the guidelines contained in the DOP&T O.M.No 22011/9/98-Estt (D), dated September 8, 1998, which prescribe the Model Calendar for DPC read with O.M. of even No dated June 16,2000.( If more than one CR have been written for a particular year, all the CRs for the relevant years shall be considered together as the CR for one year)”.
3. Sub para 6.4.3 0f DOP&T O.M No 22011/9/98-Estt (D),dated September 8,1998 provides that for the purpose of evaluating the merit of the officers while preparing year-wise panels, the scrutiny of the record of service of the officers should be limited to the records that would have been available had the DP met at the appropriate time .
4. In view of the above, the circles etc. are required to take into account only the ACRs pertaining to preceding five years that would have been available had the DPC met at the appropriate time.
5. In so far as grant of financial up gradation under BCR scheme ,it is stated that as per Directorate letter No 44-1/97-SPB,II,dated 9 .9.97,for the purpose of financial up gradation under BCR Scheme ,non-selection method was to be adopted as conveyed vide Dte lr no 4-4/92-SPB.II dated 21-3-1995.It had been further stated that `average’ grading need not disqualify an official from promotion under the BCR scheme if he was otherwise found fit by the DPC.Thus ,the circles were asked to review recommendation of the DPCs held after issue of instructions dated 21-3-1995,if considered necessary.
6. It is reiterated that Postal Circles etc should adhere to the instructions contained in Dte letter No 44-1/97-SPB.II dated 9.9.97,in so far a grant of financial up gradation under BCR Scheme for the period when the same was in existence.
