Anomaly Committee Meeting

Anomaly Committee Meeting
The anomaly committee meeting was held on 5th Feb.’10 in the Committee Room Dak Bhawan New Delhi. Shri.A.K.Sharma, Chairman presided over the meeting. The DDG (P) and other members of official side have also participated.

Grant of Supervisory Allowance to LSG/HSG-II/HSG-I Supervisors –

Non grant of graded supervisory allowance: The Official Side pointed out that this is not an anomaly of 6th CPC.
Item-14.
Higher pay scale to Supervisors:
During discussion on the item of the agenda regarding higher pay scale for the Supervisors, It was raised by the GS as to how a LSG Superviso who is drawing Rs.2800 Grade Pay can supervise BCR PAs / Postmen who are drawing Rs.4200 as grade pay and urged this anomaly should be settled. Then the department agreed to take up this issue with the Nodal Ministries.

MACP---New Findings

DPC & NEW ORDERS
The Department issued orders vide File No. 4-7/ (MACPS)/2009-PCC dated 18.9.2009 financial up gradations under the new modified Assured Career progressive scheme for 10,20 and 30 years of continuous regular service, in place of TBOP and BCR. But the experience, where the DPCs were held for MACP, it is a different experience. More than 50% of the officials did not get the financial up gradation based on the ACRs for the last five years.

The ACRs in the divisional level for the period for assessment were written very casually and mostly officials were graded as Average, Satisfactory etc which are invalid. Many appointing authorities do not know the particulars of officials whose performance they graded. This is quite un-justice with these officials. In fact the officials who are ignored of the promotions are the best performers in all the schemes, but their grading in ACRs are not so fit-n-fine.
The DOPT in its order No. 21011/1/2005-Estt. (A) dt. 6.01.2010 clarified clearly about the ACRs prior to the reporting period 2008-09, the existing grading shall be blocked. (The order is published below.)
It is important for the competent authorities holding the DPCs to act in the spirit of these orders. The Directorate also should circulate these orders with clear clairifications.
It is also reported that officials who have declined LSG/ HSG promotions before the introduction of MACP scheme were not considered for financial upgradation under MACP Scheme.now. Matter has been taken up with deptt. & urged to exempt those officials as one time measure since they were not aware of the rules of the MACP at the time of declining the LSG/HSG promotions.

AIAPS(GL) Circle & Regional office bearers are requested to meet the Director of Postal Services / PMsG / CPMsG concerned and apprise them of the DOP&T order on this subject and see that officials are not affected due to the benchmark mentioned above.

DOPT No.21011/1/2005- Estt. (A) dated the 6th January,2010
Subject: - Effect on modification / expunction of adverse remarks in the ACRs and up gradation / down-gradation of overall grading in the ACRs prior to the period 2008-2009.
The undersigned is directed to say that instructions were issued vide O.M. of even number dated 14th May, 2009 by which the complete APAR (previously known as ACR) including the overall grading and assessment of integrity shall be communicated to the concerned officer for representation if any, with effect from the reporting period 2008-09 which was to be initiated from1.4.2008. Prior to that only adverse remark in the ACR were required to be communicated for representation, if any. The then existing instructions further provided that the overall grading in the ACR should remain unchanged even after modification or expunction of the entire adverse remarks. It was left to the DPCto re-determine the overall grading if it considered that the expunction of such adverse remarks had so altered the quality of the ACR. The matter has been further considered and it has been decided that in those cases where the reckonable ACRs prior to the reporting period 2008-09 are to be considered in a future DPC on which the adverse remarks of Reporting / Reviewing/ Accepting Authorities have been expunged or modified by the Competent Authority, the “overall grading” in the ACR be kept blank for appropriate re-grading by the DPCs. The existing grading shall be blocked in such cases. It has also been decided that where the authority has upgraded / downgraded the overall grading without giving sufficient reasons, the DPC shall treat such an exercise as non-est/invalid. General terms, such as “I agree or disagree with the Reporting Officer/ Reviewing Officer” used by the Reviewing/Accepting Authority shall not be construed as sufficient reason for upgrading/downgrading the overall grading given by the Reporting Authority/Reviewing Authority. The proposals for the DPC where ACRs up to the reporting period 2007-08 will be taken into account should specifically bring out these guidelines.

Injustice with LSG / HSG cadre

The great injustice has been done with general line Supervisors by the CPC’s and Department and this cadre is the most neglected cadre not only in this Department but also in the whole of the ministries None has favored this cadre. The post of HSG-I was promotional post for ASPO’s and it has been downgraded three steps since 3rd CPC in which the pay scale of Rs 700-900 was granted to HSG-1 and similar is fate with HSG-II and LSG cadres. What will be the situation if ASPO’s , DPS/PMG and member (PSB) draws more grade pay than their boss SPO’s , CPMG and Secretary (Posts). Similar is the condition of FTP LSG\HSG-II SPM’s /APM’s who are drawing Grade pay of Rs 2800- & Rs 4200- but simple PA’s working under them are drawing more GP of Rs 4600-. A PA enters in LSG cadre generally after completion of 33-35 years of service i.e. after getting 3rd ACP. . It is therefore justified to grant grade pay more than PA’s working under them . Great resentment hence demand the following :-

1.Grade Pay 4800- for LSG/HSG-II like JAO/AAO& Grade Pay of 5400-for HSG-I.
2. Early introduction of Postmaster cadre as promised by the Secretary Posts for providing equal promotional avenues like IPO & JAO(A/C’s ) cadre.

The post of HSG-I was a higher than the post of ASPO’s and JAO but now both these cadres have been upgraded..The Post of ASPO’s has been made gazetted and JAO’s are merged in AAO and JAO pass are getting grade pay of Rs 4800-.The scale of post of HSG-I was downgraded by IV th CPC and was made equal to AAO’s . The Accounts jurisdiction of HSG-I Head Postmaster’s is very vast and he is responsible of all the accounts work of SO’s and BO’s under it and of HO itself. He is also responsible for arrangement of cash for all the PO’s under the HO. He also performs the duties of DDO. It is clear that the Department has behaved with this cadre like Step-mother and it is a clear cut anomaly .The matter may be put up before the Anomaly committee.

The Ist Central Working Committee Meeting of AIAPS(GL), after the All India Conference New Delhi ( Feb.this year),successfully held at the great religious city of north- Haridwar w.e.f. 24th July 2009 to 26th July 2009 under the Presidentship of Mr.R.Brindavanakannan,The All India President of association.Due to the prestigious retirement of Mr K.Kanniappan,General Secretary, on attaining the age of superannuation, a resolution has been moved unanimously in CWC to work undersigned as General Secretary for the running term,as earlier decided in 16th A.I.C New Delhi, Feb 2009.For this noble gesture & generous favour , I most humbly thanks you all in earnest for the trust reposed in me & shall try to do my very best to justify the position bestowed on me. On 27th July 2009 in the chamber of Sh Shiv Pujan Singh,Sr. Advocate, Supreme Court of India,New Delhi ; Mr. K.Kanniappan handed over the formal charge of General Secretary to the undersigned (Manoj Bhardwaj) & in the afternoon AIAPS deligation visited the Postal Directorate. Mr.Kanniappan introduced me with Madam Radhika Doraiswami, The Secertary Posts, as well as with Mr. Subhash Chander, Director (SR & Legel) & discussed on various issues positively. The change in the office bearers of All India Association of Postal Supervisors (G.L.) duly approved by Directorate, has been circulated vide Letter No.17-18 / 2005-SR Dated 11 Sep 2009 by the SR section under the signature of Sh. Subhash Chander, Dierctor SR & Legel, Deptt. of Posts, Dak Bhawan, New Delhi to all Heads of the Circle,PMG s,Directors & other concerns.

Department has already provided a spacious accomodation on the 4th floor of SRT Nagar Post Office Building, opposite Meghdoot Bhawan ( CPMG Delhi Office) for the purpose of Association's CHQ Office. This place is on the walking distance from Jhande-walan Metro Station & is situated in the heart of the city. This space wants proper maintenance as there is no furniture or other office / household items. Now the keys of this office are with me & I'm trying to maintain it. But it's not possible without sufficient funds & your cooperation.

Strength & Financial Position

As all of you know very well that Strength, Unity & Funds are the three basic factors for a strong organisation. Unfortunately no way to say about supervisors strength and weak financial position of association. It's time to awake. MACP has been implimented & govt.has ordered to discontinue TBOP and BCR. We must seek our position in the light of new changes. We must rather be well organised & strangthen the organisation. For the protection of honour 'n' for the steedy & redressal of our grievances, it is must for us to stand proper & well organised. In several circles, we donot have our units. In several zones, regions we have no associations.We should try to organise supervisors & form new units of AIAPS(GL) at Circle & Divisional level. For this nobel cause, I'm with you by my heart-n-soul. Just stand-up & make them realize that the interests of the postal supervisors are secure in AIAPS(GL), and not in federal unions of postal workers because, we are the senior people, we are the head of our families, we are the in-charge, we have the keys of postoffices as well as treasury. we are the post masters.

And ofcourse, we have NO FUNDS for our fight. The case of our existence is still pending in Delhi High Court & department is trying to vacate the stay given by H'ble High Court. For all such purposes we are badly in need of money. 60% arear of 6th CPC, Bonus for 60 days & 5% DA have already been paid and arear of MACP up-gradation likely to paid very soon. So I make an earnest appeal to you all to kindly collect the maximum amount of special donation as well as quota-money and remit it to CHQ Treasurer as earliest. Thanks !

DEMANDS of SUPERVISORS

A Charter of Demands sent by : Mr.J.P.Singh, SPM Joginder Nagar ( H.P.) Separate Pay Scales for LSG, HSG-II and HSG-I As all the PA’s are getting pay scales of LSG and HSG-II on promotion under OTBP and BCR and after the incorporation of III ACP system they will even get the Scale of HSG-I after completion of 30 years of service. Hence, SEPARATE pay scales for LSG, HSG-II and HSG-I is MUST depending upon their higher responsibilities and expansion of service area from Division level to Circle Level. No reservation for IPO / ASPO in HSG-I As prior to year 2000 HSG-I cadre was higher than ASPO cadre and ASPO officials were required to be promoted in HSG-I cadre before promotion to group “B”. As now, there is no such requirement and ASPO cadre is higher to HSG-I. As there is no justification of allotting some HSG-I seats to IPO cadre. Hence, allotment of HSG-I seats to IPO be apposed strongly and all such seats must be allotted to general line officials. Gazetted status to HSG-II and HSG-I officials Prior to year 2000 ASPO cadre was below HSG-I. As the ASPO cadre now enjoys gazetted status, it is regretted to point out that ASPO ( lower scale officials) are getting gazetted status and HSG-I officials are deprived from such privilege. Hence, this must be demanded effectively. Financial Powers to Postmasters As in-charge of the office, the postmaster, faces a large number of problems for the smooth functioning of office related to hardware, software and other basic amenities which requires immediate attention and money due to computerization. The postmaster has to seek permission from Divisional Head even for petty amounts of expenditure. Hence, some financial power for each problem must be given to the postmasters. Officiating pay for performing duties on higher Posts. Now a days officiating pay not allowed to some officials on the pretext that they are not eligible for that higher post. But if an official is ordered to work on a higher post it is the right of that official to get the benefits of that post. ( for example if an LSG official works in HSG-I cadre, he will be deprived of the pay of HSG-I on the pretext that he is not eligible to be promoted in HSG-I ). So if an eligible official is ordered to work on higher post it is the duty of the department to pay the appropriate wages. As per 6th pay commission report and MOF gazette notification (GSR 622 CE) dated 29-08-2008 circulated by Ministry of Communication dated 4-09-2008 Part A Pera NO.43, Entry pay in the Revised pay structure for Direct recruits appointed on or after 01-01-2006 is shown as 17140 /-.Similarly in this report, Fitment tables are shown as Annex I, where in revised Basic pay for Pre revised scale 7450-225-11500 is shown as 18460/- and revised basic Pay for Pre revised 6500-200-10500 with G.P 4200/- shown as 16290/-.As per notification , 2 different fixations of Pay of HSG I official resulting in clear cut case of Anomoly. Secondly it has also been noticed that Divisional Acctt/Acctts branch has fixed the Pay of HSG I official as per their sweet will .In some Divisions HSG I official had been fixed as per fitment table circulated in Notification where as some Divisions had fixed by adding 3% increment at the time of Promotion as fixed w.e.f 01-01-2006.All this is happening due to lack of clear cut instructions. You are therefore requested to take up the matter with Govt.of India for issuing clear cut instructions so that pay of HSG I officials be fixed correctly. Moreover Ist Para is a clear cut case of anomaly and in anomaly committee meeting it should be represented with facts in the interest of employees.
