FROM THE DESK OF GENERAL SECRETARY

Circular No.05 Dt. 20 May 2010 To:
All CHQ Office Bearers, All Circle / Regional / Divisional Secretaries,
Dear Brothers / Sisters, Namaskaar !

Hope you will find it in a healthy way ! Since the period of my previous circular dated 05 March 2010, we are srtriving under difficult circumstances to do something. We have to struggle against the attacks made on our association.
Conspiracy Made by Rival Unoins

During the re-verification process of memebership, a conspiracy was organized by National P-III union against our Supervisors Association, being afraid of our unity & strength. Director-SR & Legal wrote a letter to C.P.M.G.U.P.Circle on 03-03-2010 stating that the position of our Association in terms of recognition & also in terms of membership remain as it was at the time of passing of interim order by the court on 06-05-1997.

Objection of National association of postal employees group-c was only in regards for not to accept fresh letters of authorization in favour of our association's Saharanpur (U.P.) branch. The fact is that Supervisors Association Saharanpur U.P. branch was running smoothly. But as a result of above communication of Director SR dated 03-03-2010, SSPOs Saharanpur/ CPMG UP did'nt extend the trade union facilities to the bi-annial election of this branch held on 27th Feb 2010. This was quite illegal & undersigned opposed the misinterpretation made by department, representing to Secretary Posts & Director SR in written on 20 March 2010, 15 April 2010, 01 May 2010 and also met him personally . The sound of Director SR's communication is not limited to the U.P.circle only, but it is spreading over the other circles also. In the light of this circulation injustice is being caused to the various branches of our association and trade unioun facilities are stopped in many circles/divisions without assigning any written reason.
After my urged that depatment is forcing to this association to knock the door of court of law, Mr.Subhash Chander, Director SR & Legal, called me on phone and admitted that this action has been taken wrongly without taking the factual position of stay ordered by Ho'ble High Court in consideration. But still we are waiting for a positive reply from Department.
We Have to Make Forceful Attempt

We are a peace loving association of senior people of this department and in recognized status from more than 40 years. We always proud of our ex-leaders like Mr.N.K Sharma. Mr.K.Sarvotthaman and our patron Mr. K.Kanniappan. As you all know that the Hon'ble High Court of Delhi vide order dated 6-5-1997 passed in C.W. No. 1827/97 was pleased to order notice for 11-07-1997 and till the next date of hearing, Status Quo as of thatday, should be maintained.
What was the actual status of this association on 06-05-1997 ?

(A) We had well recognized status all over the country.
(B) We were enrolling the employees of TBOP,BCR,LSG & HSG cadre as our members.
(C) We were strictly following the RSA Rules 1956 by forming fresh branches & enrolling fresh members as well as organizing fresh biannial elections of office bearers at diffrent levels of circle/divisions.

(D) We had an approved constitution by which this association was running smoothly.

Since last 15 years department was obeying the orders of Hon'able High Court by accepting & maintaining all above A,B,C,D points positively. Now suddenly what new happened in Feb-March 2010 so that Director SR had to issue such an orders regarding a divisional branch (Saharanpur U.P.) of this association which effected adversely peaceful working of the Supervisors Association all over the country . I have detailed communicated the facts and situation of our association in my three letters addressed to Secretary Posts as well as Director SR, but NO reply is given by them.
In such a position we have to stand together to show our unity & strength to save our status and honour. As adviced by Mr K.kanniappan & other members of CWC, our senior advocate has moved an application before the Hon'ble High Court of Delhi this month, stating all the matter & the partial behaviour of department. Application is listed for hearing after vacation and we hope for an early relief in this regard.
Remittance of Quota Money / Donations

As all of you know very well that financial position of this association is not so sound. Most of the Circle and Divisional units are NOT remitting their quota money to CHQ. It's a time of our struggle to re-gain our status and we have to expend a lot of money to pay our advocate as well as in other related matters. So all of you are requested to strengthen the CHQ by remitting Quota money and also special Donations with open hand.

PLI Workshop
A workshop was organized by Postal Life Insurance Directorate, New delhi on 14th May 2010 at Postal Staff College Ghaziabad . I was invited as General Secretary of Supervisors Association . I have participated the workshop and expressed the views of our association which are appriciated very much by Dr.Uday Balakrishnan,Member Postal Service Board and Mr.S.K.Sinha,Chief General Manager PLI .
Long Live AIAPS GL !
ALL THE BEST !
Yours affectionately,
(Manoj Bhardwaj) General Secretary

Good news for LSG/HSG/TBOP/BCR employees

Consideration of ACRs and application of Bench Mark for notional Promotions in LSG/HSGII/HSGI/TBOP/BCR ------------------------------------------------------------------------------------------------------------------------------------------------------ Government of India Ministry of communications IT Department of Posts Dak Bhavan, Sansad Marg New Delhi-110001 NO 137-16/2010-SPB-II Dated the 17-May 2010 To, All chief Postmasters General/Director, Postal Staff College, All Postmasters GeneralAll Postal training centersCGM,PLI Directorate Chanakyapuri Post Office Complex New Delhi
SUBJECT:-Consideration of ACRs and application of Bench Mark for notional Promotions in LSG/HSGII/HSGI/financial up gradation under TBOPBCR scheme-Reg.

Sir/Madam
I am directed to say that one of the agenda items submitted by the staff side for discussion in the JCM relates to “Irregular application of Benchmark of current period for notional promotions.”

The staff side has stated that `the instructions of DOPT dt 16-06-2000,that only CRs for the year immediately preceding the years of vacancy/panel should be considered if DPC meetings are held later than the schedule prescribed in model calendar’, has not been taken note of by many circles and current bench marks were applied wrongly for the notional promotions. It has also been stated that in some circles, the bench mark was applied for TBOP/BCR promotion, despite the existence of clear cut orders from the Directorate that Bench mark should not be applied for BCR promotions.
2. It may be recalled that the Department of Personnel & Training (DOPT) vide its Office Memorandum No 22011/7/98-Estt (D) dated 6-10-2000,while referring to Para 6.2.1(b) of instructions circulated vide their OM No 22011/5/86-Estt(D),dated 10-4-1989,has substituted Para 6.2.1(b) as under :“:The DPC should assess the suitability of the employees for promotion on the basis of their service records and with particular reference to the CR s for five preceding years irrespective of the qualifying service prescribed in the Service/ Recruitment rules. The preceding Five years’ for the aforesaid purpose shall be decided as per the guidelines contained in the DOP&T O.M.No 22011/9/98-Estt (D), dated September 8, 1998, which prescribe the Model Calendar for DPC read with O.M. of even No dated June 16,2000.( If more than one CR have been written for a particular year, all the CRs for the relevant years shall be considered together as the CR for one year)”.
3. Sub para 6.4.3 0f DOP&T O.M No 22011/9/98-Estt (D),dated September 8,1998 provides that for the purpose of evaluating the merit of the officers while preparing year-wise panels, the scrutiny of the record of service of the officers should be limited to the records that would have been available had the DP met at the appropriate time .
4. In view of the above, the circles etc. are required to take into account only the ACRs pertaining to preceding five years that would have been available had the DPC met at the appropriate time.
5. In so far as grant of financial up gradation under BCR scheme ,it is stated that as per Directorate letter No 44-1/97-SPB,II,dated 9 .9.97,for the purpose of financial up gradation under BCR Scheme ,non-selection method was to be adopted as conveyed vide Dte lr no 4-4/92-SPB.II dated 21-3-1995.It had been further stated that `average’ grading need not disqualify an official from promotion under the BCR scheme if he was otherwise found fit by the DPC.Thus ,the circles were asked to review recommendation of the DPCs held after issue of instructions dated 21-3-1995,if considered necessary.
6. It is reiterated that Postal Circles etc should adhere to the instructions contained in Dte letter No 44-1/97-SPB.II dated 9.9.97,in so far a grant of financial up gradation under BCR Scheme for the period when the same was in existence.

Yours faithfully,
Sd/-(Suraj Bhan )

Earlier this process had gone null-n void last year, due to one of the service association knocked the door of court.
All India Association of Postal Supervisors (General Line) is not participating in the above said verification process as our Court case regarding treating the TBOP/BCR officials as Supervisors is still pending in the Hon'ble High Court, Delhi. As per the directions of the Hon'ble High Court, New Delhi in CWP No. 1827/97, status-quo about our recognition & membership is to be maintained till the case is heard and settled. Therefore, our Association will continue to enjoy the recognized status irrespective of conducting this present verification exercise. Hence, A.I.A.P.S. (GL) is an applicant service association & our name is on sl.- 14 of Annexure I. Direrctorate has acknowledged our position and made necessary remarks in the letters issued on 18-02-2010. Kindly see the Annexure I where it is clearly in column 4 Sl. no. 14 that "In this regard para 2 (V) (b) of letter of even no. dated 18-02-2010 refers". Moreover, it is clearly mentioned in Column no.3 Sl.-14 of Annexure I under the head 'Employees eligible to be included in this category' that "All supervisors LSG/HSG II including TBOP/BCR officials. Here the HSG I cadre is not mentioned. But it is a mere omission. HSG I Postmasters, Asst. Postmasters are also eligible to become Members of our Assoiciation.
Though we are not participating in the current verification process, we should not keep quiet. We have to get the Membership Declaration forms (Annexure II) filled not only from our existing members, from whom the recovery of subscription is made but also from the new members. We have to enroll more and more Members to our associations. The Membership application forms signed by the Director (SR/Legal) alone to be used for getting the membership. Hence, copy of the same (Annexure II) is enclosed herewith for taking Xerox copies and used for enrolling and renewing the membership towards our Association. The enclosed instructions received from the Directorate should be read carefully and followed without any mistake. Last date for submitting the list of letters of authorisation to divisional heads is fixed as 26th. April 2010.

All are requested to read the instructions given in the Directorate's letter Para No. (V) (b) (page no.3) where it is clearly mentioned that "Recovery of subscriptions being made in respect of service Associations on the basic of old authorization will be made till April 2010 salary (payable on 30-04-2010) except for All India Association of Postal Supervisors (GL), as in their case, as per the directions of the Hon'ble High Court, New Delhi in CWP No. 1827/97, Status-quo is to be maintained till the case is heard. This must be brought to the notice of the Divisional Heads and Pay disbursing officers in advance.
IMP. : It's golden time to reform/ reconstruct our association's units & also form new units at Divnl.level as well as at circle level. All CHQ office bearers & circle secretaries are requested to do their best efforts. Ad-hoc committee of divisions can be formed by Circle Secretaries and such excerise for circle will be authorized by undersigned. So, go ahead, form more & more ad-hoc committees at Divisl./ circle levels. Than, fill-up letter of authorization with new members & submit them to Divisl.Heads well in time.

MACP---New Findings

M A C P:
DPC & NEW ORDERS
The Department issued orders vide File No. 4-7/ (MACPS)/2009-PCC dated 18.9.2009 financial up gradations under the new modified Assured Career progressive scheme for 10,20 and 30 years of continuous regular service, in place of TBOP and BCR. But the experience, where the DPCs were held for MACP, it is a different experience. More than 50% of the officials did not get the financial up gradation based on the ACRs for the last five years.

The ACRs in the divisional level for the period for assessment were written very casually and mostly officials were graded as Average, Satisfactory etc which are invalid. Many appointing authorities do not know the particulars of officials whose performance they graded. This is quite un-justice with these officials. In fact the officials who are ignored of the promotions are the best performers in all the schemes, but their grading in ACRs are not so fit-n-fine.
The DOPT in its order No. 21011/1/2005-Estt. (A) dt. 6.01.2010 clarified clearly about the ACRs prior to the reporting period 2008-09, the existing grading shall be blocked. (The order is published below.)
It is important for the competent authorities holding the DPCs to act in the spirit of these orders. The Directorate also should circulate these orders with clear clairifications.
It is also reported that officials who have declined LSG/ HSG promotions before the introduction of MACP scheme were not considered for financial upgradation under MACP Scheme.now. Matter has been taken up with deptt. & urged to exempt those officials as one time measure since they were not aware of the rules of the MACP at the time of declining the LSG/HSG promotions.

AIAPS(GL) Circle & Regional office bearers are requested to meet the Director of Postal Services / PMsG / CPMsG concerned and apprise them of the DOP&T order on this subject and see that officials are not affected due to the benchmark mentioned above.

ALL THE BEST !
General Secretary-CHQ

*************************************************************************************
DOPT No.21011/1/2005- Estt. (A) dated the 6th January,2010
Subject: - Effect on modification / expunction of adverse remarks in the ACRs and up gradation / down-gradation of overall grading in the ACRs prior to the period 2008-2009.
The undersigned is directed to say that instructions were issued vide O.M. of even number dated 14th May, 2009 by which the complete APAR (previously known as ACR) including the overall grading and assessment of integrity shall be communicated to the concerned officer for representation if any, with effect from the reporting period 2008-09 which was to be initiated from1.4.2008. Prior to that only adverse remark in the ACR were required to be communicated for representation, if any. The then existing instructions further provided that the overall grading in the ACR should remain unchanged even after modification or expunction of the entire adverse remarks. It was left to the DPCto re-determine the overall grading if it considered that the expunction of such adverse remarks had so altered the quality of the ACR. The matter has been further considered and it has been decided that in those cases where the reckonable ACRs prior to the reporting period 2008-09 are to be considered in a future DPC on which the adverse remarks of Reporting / Reviewing/ Accepting Authorities have been expunged or modified by the Competent Authority, the “overall grading” in the ACR be kept blank for appropriate re-grading by the DPCs. The existing grading shall be blocked in such cases. It has also been decided that where the authority has upgraded / downgraded the overall grading without giving sufficient reasons, the DPC shall treat such an exercise as non-est/invalid. General terms, such as “I agree or disagree with the Reporting Officer/ Reviewing Officer” used by the Reviewing/Accepting Authority shall not be construed as sufficient reason for upgrading/downgrading the overall grading given by the Reporting Authority/Reviewing Authority. The proposals for the DPC where ACRs up to the reporting period 2007-08 will be taken into account should specifically bring out these guidelines.

2. It is also made clear that past cases already decided will not be re-opened

Injustice with LSG / HSG cadre

A.I.A.P.S.(GL) H.P.Circle

Narender Kumar C/S reported to CHQ
Anomaly\ injustice
with the grade Pays of
LSG \ HSG-II \ HSG-I
in Post offices
The great injustice has been done with general line Supervisors by the CPC’s and Department and this cadre is the most neglected cadre not only in this Department but also in the whole of the ministries None has favored this cadre. The post of HSG-I was promotional post for ASPO’s and it has been downgraded three steps since 3rd CPC in which the pay scale of Rs 700-900 was granted to HSG-1 and similar is fate with HSG-II and LSG cadres. What will be the situation if ASPO’s , DPS/PMG and member (PSB) draws more grade pay than their boss SPO’s , CPMG and Secretary (Posts). Similar is the condition of FTP LSG\HSG-II SPM’s /APM’s who are drawing Grade pay of Rs 2800- & Rs 4200- but simple PA’s working under them are drawing more GP of Rs 4600-. A PA enters in LSG cadre generally after completion of 33-35 years of service i.e. after getting 3rd ACP. . It is therefore justified to grant grade pay more than PA’s working under them . Great resentment hence demand the following :-

1.Grade Pay 4800- for LSG/HSG-II like JAO/AAO& Grade Pay of 5400-for HSG-I.
2. Early introduction of Postmaster cadre as promised by the Secretary Posts for providing equal promotional avenues like IPO & JAO(A/C’s ) cadre.
The below is the illustration\comparison and clear picture how these cadres have suffered badly for the few decades:-
CPC Comparison of cadres
LSG IPO HSG-II ASPO’ s HSG-I SPO’s
3rd- 425-700,425-700,550-800,550-800,700-900,650-1050,
4th- 1400-2300,1400-2300,1600-2600,1640-2600,2000-3200,2000-3500,
5th- 4500-7000,5500-9000,5000-8000,6500-10500,6500-10500,7500-12000,
6th- GP 2800,GP 4200,GP 4200,GP 4600 ,GP 4600,GP 4800
The post of HSG-I was a higher than the post of ASPO’s and JAO but now both these cadres have been upgraded..The Post of ASPO’s has been made gazetted and JAO’s are merged in AAO and JAO pass are getting grade pay of Rs 4800-.The scale of post of HSG-I was downgraded by IV th CPC and was made equal to AAO’s . The Accounts jurisdiction of HSG-I Head Postmaster’s is very vast and he is responsible of all the accounts work of SO’s and BO’s under it and of HO itself. He is also responsible for arrangement of cash for all the PO’s under the HO. He also performs the duties of DDO. It is clear that the Department has behaved with this cadre like Step-mother and it is a clear cut anomaly .The matter may be put up before the Anomaly committee.

Strength & Financial Position

As all of you know very well that Strength, Unity & Funds are the three basic factors for a strong organisation. Unfortunately no way to say about supervisors strength and weak financial position of association. It's time to awake. MACP has been implimented & govt.has ordered to discontinue TBOP and BCR. We must seek our position in the light of new changes. We must rather be well organised & strangthen the organisation. For the protection of honour 'n' for the steedy & redressal of our grievances, it is must for us to stand proper & well organised. In several circles, we donot have our units. In several zones, regions we have no associations. We should try to organise supervisors & form new units of AIAPS(GL) at Circle & Divisional level. For this nobel cause, I'm with you by my heart-n-soul. Just stand-up & make them realize that the interests of the postal supervisors are secure in AIAPS(GL), and not in federal unions of postal workers because, we are the senior people, we are the head of our families, we are the in-charge, we have the keys of postoffices as well as treasury. we are the post masters.

And ofcourse, we have NO FUNDS for our fight. The case of our existence is still pending in Delhi High Court & department is trying to vacate the stay given by H'ble High Court. For all such purposes we are badly in need of money. 60% arear of 6th CPC, Bonus for 60 days & 5% DA have already been paid and arear of MACP up-gradation likely to paid very soon. So I make an earnest appeal to you all to kindly collect the maximum amount of special donation as well as quota-money and remit it to CHQ Treasurer as earliest. Thanks !

Rest in the next...
